The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Chair; Tom Little, Frank Magsamen, John Miller and Craig White.
Absent: None.
Unless otherwise noted, all actions were approved unanimously.
Moved by Little, seconded by White that the AGENDA be received and place on file with the County Auditor as approved. Motion carried.
The Board of Supervisors acknowledged the following employees for years of service: Grant Veeder, County Auditor, for thirty-five years of service.

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said gravel roads are in fairly good condition, and the contractor installing the power lines is rocking a few miles on Leversee Road (per their contract) and county graders are spreading the rock. She said she attended the National Association of County Engineers meeting in Tacoma, WA the prior week, and relayed some of what she learned about a systematic approach to safety.
Superintendent of Maintenance Rory Geving said that the courthouse chiller failed more than a week prior due to leaks in the condenser barrel. He said five of the 282 tubes had been breached, and those were plugged along with twenty-five more that showed excessive wear. He said all of the Freon (700 pounds) was lost, and he would give more detailed cost information when available.
Moved by Miller, seconded by Little that the MINUTES of the Board Meeting held April 26, 2016 be and are hereby approved as submitted. Motion carried.

White moved the following resolution seconded by Miller.
BE IT HEREBY RESOLVED to approve CHANGE ORDER 2 received from Woodruff Construction, Waterloo, Iowa, and direct the Chair to sign for same as recommended by Rory Geving, Maintenance Superintendent, in the amount of $7,110.00 for the following: repairs to the electrical conduits that were encountered and damaged during plumbing trench demolition in the basement floor slab ($3,751.25), one (1) additional 36×36 mirror ($228.29), two (2) DW-100 wall switches in lieu of the specified toggle switches, one in each of the 2nd floor restrooms ($297.36), concrete scanning the second floor bathroom plumbing penetrations ($702.42), two (2) additional 24×72 mirrors ($995.10), remove existing lintels and masonry above the (2) door openings; infill with 6” metal studs and drywall each; finish drywall; paint corridor side area 2’ x 18’; tie back existing acoustical ceiling on corridor side ($1,135.58).
Geving said that the electrical conduits that were damaged in the basement weren’t expected because embedding conduits in concrete is atypical these days. He said the concrete scanning for the second floor was added because of the experience in the basement, and it paid off because similar embedded conduit was found. He said the mirrors were omissions in the specifications, and unexpected lintels were found over the door openings, which had to be raised to meet ADA standards.

Magsamen moved the following resolution seconded by White.
BE IT HEREBY RESOLVED that AMENDMENT 1 to the System Purchase Contract between Black Hawk County and RACOM Corporation, Marshalltown, Iowa, be approved and direct the Chair to sign for same as recommended by the E911 Service Board.
Magsamen said that this allows other communities to take advantage of the bids that the county has done, and it is at no cost to the county.

BE IT HEREBY RESOLVED that the DATA GRANT AGREEMENT between Black Hawk County and Youngme Seo with Iowa State University to use GIS Data for studying how much energy efficiency is capitalized into housing process in Cedar Falls be approved and direct the Chair to sign for same as recommended by Kim Veeder, Information Technology Director.

Miller moved the following resolution seconded by Little.
WHEREAS, the Black Hawk County Board of Supervisors on October 13, 1980 by Resolution vacated property, including the following:
The S ½ of the alley adjoining Lot No. Seven (7) except the West 14 feet, and the S ½ of the alley adjoining Lot No. Eight (8) except the East 15 feet, and the N ½ of the alley adjoining Lot No. Fifteen (15), and the S ½ of Washington Street adjoining Lot No. Fifteen (15).
Although the Resolution was completed, the County neglected to provide a Quit Claim Deed as stated in the Resolution.
BE IT HEREBY RESOLVED that pursuant to the action of October 13, 1980, the Board of Supervisors authorize the Chair to sign a Quit Claim Deed conveying the County’s interest in the subject matter real to Charles J. Linhart and Sally J. Linhart, husband and wife, as joint tenants with full rights of survivorship.

BE IT HEREBY RESOLVED to receive and endorse the 2016-2020 Black Hawk County Resource Enhancement and Protection (REAP) Plan.
Black Hawk County REAP Chair Roger White said that the county has received over $6.6 million in REAP funds in the last 25 years, which has always been matched, 2-1 or even 3-1, by local public and private donations.

Moved by White, seconded by Magsamen to approve the $10,000 pledge to the Waterloo Fire & Rescue for the care and maintenance of an accelerant canine as recommended by Brian Williams, County Attorney.
Williams said this has been in the works since 2011, and such a resource is very important, especially in the light of a number of recent unexplained fires. Magsamen, a former Waterloo fire chief, said that he recalled where the evidence provided by an accelerant canine was often the key to obtaining a conviction in arson trials. Motion carried.
Moved by Miller, seconded by White that the REQUEST FOR PURCHASE OF CAPITAL EQUIPMENT submitted by Ashley Lutgen, County Social Services Clinical Director, be approved and direct the Chair to sign for same: $4,500 to furnish the conference room, printer and waiting room/welcoming area for the new Training and Triage Center at 1450 West Dunkerton Road, Waterloo (funding will be reimbursed by the County Social Services Region). Furniture requested includes: one (1) conference room table, eight (8) conference room chairs, (1) black leather couch, two (2) black leather chairs, one (1) coffee table and one (1) corner table. Bids were requested from three different furniture merchandise companies in Iowa. Motion carried.
Moved by White, seconded by Little to to approve the PERSONNEL REQUISITION submitted for an Engineering Tech Aide II (full-time, replacement) effective May 3, 2016 as recommended by Catherine Nicholas, County Engineer. Motion carried.
Moved by Miller, seconded by White that the TRAVEL REQUEST submitted by Audra Heineman, Human Resources Director, be approved and direct the Chair to sign for same: $193.37 for Debi Bunger and Marianne Wood to attend the Iowa Public Employers Labor Relations (IaPELRA) Spring Conference in Cedar Rapids, Iowa on May 6, 2016. Motion carried.
Moved by Little, seconded by White that the three part-time Medical Examiner Deputies of the Black Hawk County Medical Examiner Officer be approved as recommended by Dr. Mark Bickley, Black Hawk County Medical Examiner: Jason Hernandez, Tara Duncan, and Angie Fuller. Motion carried.
ANY REPORTS OR INFORMATION FROM THE BOARD. White said that there is still a box for torn, tattered and faded flags on first floor of the courthouse, which will be given to Cub Scouts for flag retirement.
Miller said that the legislature adjourned without approving the legislation that would have equalized the county contribution within mental health regions, which will mean higher property taxes in Black Hawk County.
