                The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment.  The meeting was called to order and on roll call there were present: Frank Magsamen, Chair; Linda Laylin, Tom Little, Chris Schwartz and Craig White.

                Absent:  None.

                Unless otherwise noted, all actions were approved unanimously.

                Moved by Little, seconded by White that the AGENDA be received and place on file with the County Auditor as approved.  Motion carried.

                RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS:  County Engineer Cathy Nicholas said they have taken receipt of their new trucks.  The paved roads are in good shape.  Gravel roads are reasonably good and right now without frost boils.  The construction crews are casting beams for the new bridge on Cunningham Road where the old bridge will be demolished and replaced.  The staff is also working on the five-year plan.

                BE IT HEREBY RESOLVED that the AMENDMENT TO AGREEMENT between Black Hawk County and the City of Cedar Falls for space to house certain County owned vehicles and equipment, to provide for purchase of fuel by the County from the City, to provide space for use of one or more County employees for repairs and maintenance services at the Cedar Falls Public Works Facility for the Health Department be approved and direct the Chair to sign for same as recommended by Patricia Humpal, Budget and Accounting Manager and Eileen Daley, Division Manager Enforcement, Surveillance and Preparedness. Daley explained that this agreement allows the Health Department to stage up to two vehicles for staff to have access to for the northwest part of the county.

                Little moved the following resolution seconded by White.

                BE IT HEREBY RESOLVED to approve CHANGE ORDER #4 received from Murphy Tower Service, LLC, Carlisle, Iowa in the amount of $6,450.00 for additional grounding work at the Hudson Tower Site and additional work to locate the generator annunciator panel at the Waterloo Tower Site and direct the Chair to sign for same as recommended by the Black Hawk County E911 Service Board.  Sheriff Tony Thompson said the old wooden fence broke upon removal in Hudson and the new replacement will be grounded.

                Moved by White, seconded by Schwartz to direct the County Auditor to advertise for a public hearing to be held at 9:05 a.m. on Tuesday, March 14, 2017 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa on the proposed Ordinance No. 77-182 on the request submitted by Alf Properties, LLC to rezone 32.2 acres from “A” Agricultural District to “C-M” Commercial and Manufacturing District in order to construct a tree farm and nursery, landscape business, and retail garden center. The property is located at the southwest corner of Highway 218 and West Cedar Wapsi Road (County Highway C-57) and legally described as:  The Northwest Quarter of the Northwest Quarter of Section 13, Township 90 North, Range 14 West of the 5th P.M., Black Hawk County Iowa, except the North 255 feet of the West 228 feet thereof and except the North 50 feet thereof conveyed for road purposes and further except that part condemned by the State of Iowa in Co. #2015-12385. South of 5640 West Cedar Wapsi Road – ALF Properties, LLC from “A” to “C-M”).  Motion carried.

                BE IT HEREBY RESOLVED to fix a date of hearing to be held on the 7th day of March, 2017, at 9:04 A.M., in Board Room 201, Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa, at which meeting the Board proposes to take additional action for the application of not to exceed $671,500 of the bond proceeds of the General Obligation Bonds, Series 2015A, for essential county purposes.

                Moved by Laylin, seconded by White that the TRAVEL REQUEST submitted by Susan Deaton, Finance Director, be approved and direct the Chair to sign for same: up to $452.18 to attend the ISAC Legislative Conference in Des Moines, IA scheduled March 9 – 10, 2017.  Motion carried.

 

                Moved by Laylin, seconded by Schwartz that the TRAVEL REQUEST submitted by Chris Schwartz, Board of Supervisors, be approved and direct the Chair to sign for same: up to $662.96 to attend the ISAC Legislative Conference in Des Moines, IA scheduled March 8 – 10, 2017.   Motion carried.

 

                Moved by White, seconded by Laylin to approve the PERSONNEL REQUISITION submitted for a Temporary Seasonal Civil Engineer Tech Aide I (full-time) as recommended by Catherine Nicholas, County Engineer.  Nicholas said they hire one student each summer from May to early August.  The pay will be $14.00 per hour and they will assist in updating the sign inventory system and the retro reflectivity program.  Motion carried.

 

 

 

Schwartz moved the following resolution seconded by Little.

                BE IT HEREBY RESOLVED to retroactively approve the application submitted by the Board of Supervisors for the Paul Coverdell Forensic Science Improvement Act Grant through the State of Iowa Medical Examiner Officer effective February 27, 2017.

                NAYS:  None.                                                     Resolution adopted.

 

                White moved the following resolution seconded by Schwartz.

                BE IT HEREBY RESOLVED that the Black Hawk County Board of Supervisors go on record as opposing Iowa House Study Bill 92, Iowa House File 295, and any other legislation proposed now or in the future which seeks to eliminate or diminish Iowa’s long standing legal precedent of home rule.  This proposed legislation is an assault on the concept of local control and is punishing counties and municipalities who have taken action when the state legislature has failed to do so. We will not silently forfeit our duty to protect the civil rights of our citizens, nor our duty to enact ordinances that improve the health, safety, and economic prosperity of our community. 

BE IT FURTHER RESOLVED that a copy of this resolution be immediately sent to members of the Iowa Press.

BE IT FURTHER RESOLVED that a copy of this resolution be immediately sent to the Office of the Governor and every member of the Iowa State Legislature.

                Schwartz said this bill goes beyond civil rights but also the power to prevent discrimination in the areas of employment and housing.

BE IT HEREBY RESOLVED that the Black Hawk County Board of Supervisors officially invites Senator Chuck Grassley, Senator Joni Ernst, and Representative Rod Blum to each participate in a separate public town hall meeting hosted by the Black Hawk County Board of Supervisors in either Waterloo or Cedar Falls Iowa, our counties two largest population centers.  These town halls meetings will take place in a large public venue, with an ample sound system, during evening or weekend hours to ensure maximum participation from our communities working families.  Each of these separate town hall meetings will last two hours long. The first thirty minutes will consist of questions directly from the Board of Supervisors on county issues directly impacted by federal policies and legislation. The remaining ninety minutes will consist of directly taking questions from the citizens of Black Hawk County.  These public town hall meetings should take place during or before the lengthy designated state work period of April 10th-April 21st.

White said that he was not in favor of the town hall style of meeting to pound on them like those seen in the news lately.  During budget meetings he brought up the need to have them see firsthand the situation at Country View.  He feels it is the most important issue the County has. He would like to be gracious to them and see how much care the residents need and that the employees take good care of them.  Little said that over the years the Board has held meeting with our representatives and he feels that will continue.   Schwartz said he has more than once invited Grassley to come to Country View.  He feels the discussions can be done in cordial way.  Magsamen said the town hall could be held at Country View.  Laylin said she supports the resolution as an invitation for them to come and dialog.
