The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Chair; Tom Little, Frank Magsamen, John Miller and Craig White.
Absent: None.
Unless otherwise noted, all actions were approved unanimously.

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said she held a well-attended public meeting last week at the Rotary Reserve where she told people about the two options for rebuilding the Cedar Wapsi Road over the Cedar River to wit: (a) Build a bridge on the site of the existing bridge, which could cause a two-year detour, for about $6.5 million. (b) Move the bridge site 55 feet south, causing a slight realignment, for about $7.2 million. Environmental studies are mostly done, but the discovery of an archaeological artifact in the southern alignment caused a more in depth study that should be done by early December. She also talked to the group about the new E911 sign ordinance. Magsamen said he attended the meeting and heard concerns about the length of the detour for Option A.

BE IT HEREBY RESOLVED that the STATEMENT OF COMPLETION and FINAL ACCEPTANCE OF WORK for Project FM-C007 (129)–5B-07 Dysart Road (V37) Grading and PCC Paving from .25 miles south of D38 to Orange Road be approved and direct the Chair to sign for same and authorize and direct the Iowa Department of Transportation to make final payment from the County’s Farm-to-Market Fund in the amount of $21,643 with a total project cost of $1,359,289.09 as recommended by Catherine Nicholas, County Engineer. (Project contracted at $1,414,571.84 total working days specified 64, working days used 78, liquidated damages assessed $16,800 contractor, Peterson Contractors, Reinbeck, Iowa).
Nicholas said the project came in 4% under contract. And the liquidated damages will come off the final payment, and the road is much improved.

Motion carried.
Moved by Magsamen, seconded by White to direct the County Auditor to advertise for a public hearing to be held at 9:05 a.m. on Tuesday, November 22, 2016 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa on the proposed Ordinance No. 77-179 on the request submitted by Paul and Betty Jean Borgwardt to rezone 4.83 acres from to “A” Agricultural District to “A-R” Agricultural Residential District, to allow for the construction of three single-family dwellings. At 9:12 a.m., a public hearing was held as provided by law in the Board Room 201 of the Black Hawk County Courthouse, Waterloo, Iowa at which time all interested persons could appear to file objections on Ordinance No. 139 entitled “An Ordinance adding Chapter 12.25 Uniform Rural Address Systems to Title 12 Streets, Sidewalks and Public Places of the Black Hawk County Code of Ordinances”. The proposed Ordinance mandates the use of a uniform address naming system to promote the health, safety, welfare and convenience of residents throughout Black Hawk County and provides for specific fees and penalties in the development, installation and operation of a county-wide Uniform Rural Address System that fosters the rapid and effective response of law enforcement, fire rescue and emergency medical service personnel in meeting the emergency needs of county residents.
Moved by Little, seconded by Miller to receive and place on file proof of publication of notice of public hearing. Motion carried.
Moved by White, seconded by Magsamen to waive the reading of Ordinance No. 139 as notice was published in the Waterloo Courier on October 28, 2016 and copies were available for public inspection in the Black Hawk County Board of Supervisors Office, Room 203 of the Black Hawk County Courthouse, Waterloo, Iowa. Motion carried.
There were no oral or written objections.
County Engineer Cathy Nicholas said that she spoke to the E911 Board, which was fully in favor of the ordinance. She said postcards would be sent to all rural residents, and wondered if they should be sent now or early spring, closer to the June 1, 2017 enforcement date. Miller said to send them as soon as possible, before the frost goes into the ground. Laylin said she understood that Secondary Roads could as a rule install the signs during the winter. Nicholas said that is true. Magsamen said to check if there are any other mass mailings going on that this one could be joined to for economy’s sake. Laylin asked if residents just needed to be signed up to have their signs up by June 1, or if they had to have their signs up by June 1. Assistant County Attorney Peter Burk said that the signs don’t need to be erected by June 1 as long as the residents are signed up.
Moved by Little, seconded by Magsamen to close the hearing after oral/written comments are received. Motion carried.
White moved the following resolution seconded by Miller.

BE IT HEREBY RESOLVED that pursuant to the provisions of the Iowa Open Meetings Law, the Black Hawk County Board of Supervisors shall proceed into CLOSED SESSION AT 9:19 A.M., with attorney to discuss strategy with counsel in the matter of Felts vs. Deputy Hoffman pursuant to Iowa Code §21.5(1c).
AYES: Little, Magsamen, Miller, White, Laylin.
NAYS: None. Resolution adopted.
Moved by Miller, seconded by Little to adjourn the Board of Supervisors Meeting in CLOSED SESSION at 10:02 am. Motion carried.
White moved the following resolution seconded by Magsamen.
BE IT HEREBY RESOLVED to accept proposed mediation settlement in Felts vs. Deputy Hoffman in the amount of $30,000.
AYES: Little, Magsamen, Miller, White, Laylin.
NAYS: None. Resolution adopted.
