The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Chair; Tom Little, Frank Magsamen, John Miller and Craig White.
Absent: None.
Unless otherwise noted, all actions were approved unanimously.

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said flood cleanup was complete and no roads are closed due to flood damage. Raymond Road is closed due to construction on Crane Creek bridge, and unfortunately dust control cannot be replaced on the detour at this time. The Elk Run Road bridge project is being deferred to next spring at the request of the contractor. There’s a guardrail project on Dubuque Road and a culvert replacement on West 27th Street that will close that road for about two weeks. The C-57/US-218 interchange will open October 14. Magsamen asked if there is an estimate on the cost of flood damage. Nicholas said she has an initial estimate in the $60-70,000 range, and she is meeting with FEMA on October 16 to visit sites that suffered flood damage.

BE IT HEREBY RESOLVED that the BEST BID (bids opened Monday, September 26, 2016) received from Kluesner Construction, Inc., Farley, Iowa for the routing, cleaning and sealing of pavement cracks at various locations in Black Hawk County in the amount not to exceed $66,000 and Slurry Leveling of Dunkerton in the amount of $15,125 for a total amount of $81,125 be approved as recommended by Catherine Nicholas, County Engineer.
Nicholas said she contacted five or six potential bidders and received two bids, both of whom have done good work for the county in the past.

BE IT HEREBY RESOLVED that the CONTRACT between Black Hawk County and Kluesner Construction, Inc., Farley, Iowa for the routing, cleaning and sealing of pavement cracks at various locations in Black Hawk County in the amount not to exceed $66,000 and Slurry Leveling of Dunkerton in the amount of $15,125 for a total amount of $81,125 be approved and to direct the Chair to sign for same and to receive and place on file the certificate of insurance and performance bond as recommended by Catherine Nicholas, County Engineer.
Nicholas said she hopes work will begin immediately.

BE IT HEREBY RESOLVED that the STATEMENT OF COMPLETION and FINAL ACCEPTANCE OF WORK for Project FM-C007(139)–55-07 Kimball Avenue Resurface and for Project FM-C007(140)–55-07 Raymond Road Resurfacing on Raymond Road (V49) be approved and direct the Chair to sign for same and authorize and direct the Iowa Department of Transportation to make final payment from the County’s Farm-to-Market Fund in the amount of $30,000 with a total project cost of $1,290,770.37 as recommended by Catherine Nicholas, County Engineer.(Project contracted at $1,370,932.05 with total working days specified 60, working days used 51, liquidated damages assessed $0 contractor, Aspro, Inc., Waterloo).
Nicholas said the project was done well and was under budget by 6%.

Moved by Little, seconded by White that the PERSONNEL REQUISITION for an Equipment Operator I (full-time, replacement) in the Secondary Roads Department effective October 11, 2016 be approved. Motion carried.
Magsamen moved the following resolution seconded by White.
BE IT HEREBY RESOLVED that the promotion of employee Monica Paulsen to the Transition Specialist position with an annual salary of $56,000 effective October 10, 2016 be approved as recommended by Karen Dowell, Chief Operating Officer Mental Health and Disability Services.
Dowell said the salary will be reimbursed by the County Social Services consortium. She said that the Transition Specialist will work with case managers to determine where an individual in crisis can best be served, depending on the severity of the crisis. The Specialist will oversee two other service coordinators.
Human Resources Director Audra Heineman said that policy is that when a promotion results in a pay increase of more than 5% that it must be approved by the Board of Supervisors. She said due to the position’s uniqueness it’s difficult to make an external comparison, and that while internal comparisons show a lack of movement in some positions she supported the offer. Laylin said that the topic can be discussed at budget time.
Miller asked if the Transition Specialist will work outside Black Hawk County. Dowell said that the position will be based in Black Hawk County but will work with individuals both inside and outside the twenty-two county consortium. Magsamen asked if her duties will change when the Crisis Stabilization Center opens. Dowell said no.

BE IT HEREBY RESOLVED that the TAXES DUE AND PAYABLE of the submitted persons, as indicated, including special assessments, and rates or charges, including interest, fees and cost, in accordance with the provision of §427.9 of the Code of Iowa, be suspended and that future property taxes on property owned by the persons will be suspended for such time as the persons remains the owner of the parcels, and during the period the persons receives assistance as described in §427.9 of the Code of Iowa.

NAYS: None. Resolution adopted.
Moved by Little, seconded by Miller to direct the County Auditor to advertise for a public hearing to be held at 9:07 A.M. on Tuesday, October 25, 2016 in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa on the proposed Ordinance No. 138 adding Chapter 8.25 Private Wastewater Disposal Systems to Title 8 Health and Safety of the Black Hawk County Code of Ordinances. Motion carried.
CLOSED SESSION
Miller moved the following resolution seconded by Magsamen.
BE IT HEREBY RESOLVED that pursuant to the provisions of the Iowa Open Meetings Law, the Black Hawk County Board of Supervisors shall proceed into CLOSED SESSION AT 9:17 A.M., with attorney to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation pursuant to Iowa Code §21.5(c).

NAYS: None. Resolution adopted.
