Waterloo, Iowa January 31, 2017

                The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment.  The meeting was called to order and on roll call there were present: Frank Magsamen, Chair; Linda Laylin, Tom Little, Chris Schwartz and Craig White.

                Absent:  None.

                Unless otherwise noted, all actions were approved unanimously.

                Moved by Little, seconded by White that the AGENDA be received and place on file with the County Auditor as approved.  Motion carried.

                PUBLIC COMMENTS.  Tom Leohr read material critical of wind turbines, which he said companies build for the subsidies, which are worth more than the energy produced.  Debbie Nieman opposed wind towers, saying that of 43 landowners who signed up for them, only 14 live in the area.  She said property values drop 25-45%, if you can sell your property at all.

                RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS.  County Engineer Cathy Nicholas said thawing has created bad spots on some gravel roads, and Secondary Roads is placing rock in those places when they freeze.  She is still taking requests for E911 address signs, and now has a backlog of 1100.

                Little moved the following resolution seconded by White.

                BE IT HEREBY RESOLVED that the CONTRACT between Black Hawk County and Taylor Construction, Inc., New Vienna, Iowa (bid opening December 20, 2016) for Project BROS-C007(141)–5F-07 Bridge Replacement on C66 (W. Dunkerton Road) from V25 (Wagner Road) west 0.25 miles on North line of S33-T90-R13 in the total amount of $440,669.85 (late Start Date: July 10, 2017; Working Days: 75; liquidated Damages: $1,000 per day) be approved and direct the Chair to sign for same and to receive and place on file the Contractor’s Bond and Certificate of Insurance as recommended by Catherine Nicholas, County Engineer.

                Nicholas said this was the lowest of four bids, that the estimate was $492,000, and that construction would probably start in June or July.

                Schwartz moved the following resolution seconded by Little.

                BE IT HEREBY RESOLVED to retroactively approve the application submitted by the Board of Supervisors for the Lucas Assist Device for Cardiac Arrest Program Grant through the State of Iowa effective January 27, 2016.  

                Board Administrative Assistant Amanda Fesenmeyer said that the county is eligible for six devices based on population, and they will be distributed to emergency services in various communities in the county.

                Schwartz moved the following resolution seconded by Laylin.

WHEREAS, in response to economic conditions in Black Hawk County and the plight of low wage workers in our community, the Board of Supervisor wishes to explore the impact a local minimum wage ordinance would have on our community. 

WHEREAS, the Board of Supervisors wishes to create an Advisory Committee consisting of members from a broad cross-section of our community  to  study  the  impact  of a  Minimum Wage Ordinance  and provide  input and recommendations  to the Board  of  Supervisors. 

NOW, THEREFORE THE BLACK HAWK COUNTY BOARD OF SUPERVISORS DOES HEREBY RESOLVE AS FOLLOWS: that formation of a Black Hawk County Minimum Wage Advisory Committee is in the best interest of the citizens and businesses of Black Hawk County.  The Board further finds that the Committee will provide assistance by understanding the challenges of low wage workers in our community, the needs of employers and the impact of a county minimum wage ordinance. With this knowledge, the Committee will be able to make recommendations to the Board of Supervisors regarding the adoption and implementation of a minimum wage ordinance and possible amendments.

BE IT FURTHER RESOLVED that the Black Hawk County Minimum Wage Advisory Committee will be subject to all aspects of Iowa’s Open Meetings Laws.

BE IT  FURTHER  RESOLVED that the Black Hawk County Minimum Wage Committee shall consist of 11 members appointed by the Board of Supervisors, that each supervisor shall nominate at least two members, and that two supervisors shall serve as ex-officio members of the committee.

BE IT FURTHER RESOLVED that the Committee shall be created according  to  the  Organizational Guidelines attached here to which may be revised from time  to  time  as recommended  by the Committee  and approved by the Board  of  Supervisors.

Schwartz said that the minimum wage hasn’t been raised at the state or federal level since 2007, and that $7.25 is a poverty wage that negatively affects our economy and our property values.  After feedback from the Board, Schwartz agreed to include language in the resolution that directed each supervisor to nominate members of the committee, and that two supervisors would serve as ex-officio members.

Laylin said that she has worked in economic development for 25 years and is passionate about fair and equitable compensation for employees, but she has told Schwartz that she needed more information and more discussion by the Board.

                AYES:  Little, Schwartz, White, Magsamen.

                NAYS:  Laylin.                                                   Resolution adopted.

                ANY REPORTS OR INFORMATION FROM THE BOARD.  Schwartz said that President Trump’s executive orders about immigrants, refugees and a border wall have caused concern, and said Black Hawk County has benefited culturally and economically from refugee populations.  He encouraged people to join a rally against unconstitutional actions at Representative Rod Blum’s county office at 2:30 on February 5.

After a brief recess, the Board considered various aspects of the FY18 Black Hawk County Budget.  Finance Director Susan Deaton and Sheriff Tony Thompson presented the Sheriff’s budget, and Deaton presented budget numbers for the Criminal Justice Information System and Civil Service.  Deaton and Health Department Director Nafissa Cisse Egbuonye explained the Health Department budget, and Egbuonye explained her focus on national accreditation by the Public Health Accreditation Board.

Deaton then presented and the Board discussed budget scenarios based on different ways of making capital purchases, with and without use of bonded indebtedness.
