                The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment.  The meeting was called to order and on roll call there were present: Frank Magsamen, Chair; Linda Laylin, Tom Little, Chris Schwartz and Craig White.

                Absent:  None.

 

                Unless otherwise noted, all actions were approved unanimously.

 

                Moved by Little, seconded by White that the AGENDA be received and place on file with the County Auditor as approved.  Motion carried.

                Schwartz moved the following resolution seconded by Laylin.

                BE IT HEREBY RESOLVED that the 28E CONTRACTUAL AGREEMENT between Black Hawk County and the City of Raymond, Iowa for the purpose of providing law enforcement services effective July 1, 2017 through June 30, 2018 in the amount of $23,368.77 be approved and the Chair be directed to sign for same as recommended by Tony Thompson, County Sheriff.

                Little said he wouldn’t support the agreement because it doesn’t show an increase over the current agreement, even though the Sheriff’s budget is going up.

                Moved by White, seconded by Schwartz to approve the PERSONNEL REQUISITION submitted for an Office Specialist (full-time, replacement) as recommended by Sandie Smith, County Recorder.  Motion carried.

                Moved by Little, seconded by White that the APPOINTMENT of Tony Woods as the 2017 Black Hawk County Weed Commissioner be approved as recommended by Cathy Nicholas, County Engineer.  Motion carried.

                Little  the following resolution seconded by White.

                BE IT HEREBY RESOLVED that each owner and each person in possession or control of any land in unincorporated Black Hawk County shall cut, burn, or otherwise destroy all noxious weeds thereon, as defined in the provisions of §317 of the Code of Iowa, at such time in each year and in such manner as shall prevent said weeds from blooming or coming to maturity, and shall keep said lands free from such growth of any other weeds as shall render the streets or highways adjoining said land unsafe for public travel. Noxious weeds shall be cut or otherwise destroyed on or before June 1, 2017, and as often thereafter as is necessary to prevent said production and to direct the publication of notice in the official newspapers of Black Hawk County.

BE IT HEREBY RESOLVED to fix a date of hearing to be held on the 28th day of March, 2017, at 9:05 A.M., in Board Room 201, Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa, at which meeting the Board proposes to take action on the matter of the issuance of not to exceed $750,000 General Obligation Bonds, for essential county purposes, the proceeds of which bonds will be used to provide funds to pay the costs of improvements to public buildings and grounds, including reconstruction of the jail facility parking lot.

                AYES:  Laylin, Little, Schwartz, White, Magsamen.

                NAYS:  None.                                                     Resolution adopted.

Nine-oh-nine o’clock (9:09) a.m., a public hearing was held as provided by law in the Board Room 201 of the Black Hawk County Courthouse, Waterloo, Iowa at which time all interested persons could appear to file objections on the request submitted by Alf Properties, LLC to rezone 32.2 acres from “A” Agricultural District to “C-M” Commercial and Manufacturing District in order to construct a tree farm and nursery, landscape business, and retail garden center. The property is located at the southwest corner of Highway 218 and West Cedar Wapsi Road (County Highway C-57) and legally described as:  The Northwest Quarter of the Northwest Quarter of Section 13, Township 90 North, Range 14 West of the 5th P.M., Black Hawk County Iowa, except the North 255 feet of the West 228 feet thereof and except the North 50 feet thereof conveyed for road purposes and further except that part condemned by the State of Iowa in Co. #2015-12385. South of 5640 West Cedar Wapsi Road – ALF Properties, LLC from “A” to “C-M”).

The Board of Supervisors examined proof of publication of notice and determined that the notice had been published on March 1, 2017 in the Courier in accordance with the requirements of the Code of Iowa.

Moved by Little, seconded by Little to receive and place on file proof of publication of notice of public hearing.  Motion carried.

                Moved by White, seconded by Little to waive the first reading. Motion carried.

                Seth Hyberger of Planning and Zoning said the proposed use was compatible with other commercial and industrial uses in the area, and the applicants said they had no plans to build in the flood zone.  The Technical Review Committee had no concerns.

Moved by Schwartz, seconded by White to close the hearing and oral and written comments were received and placed on file.  Motion carried.

                Laylin moved the following resolution seconded by Schwartz.

WHEREAS, a public hearing was held on March 14, 2017 at Nine-oh- o’clock (9:) a.m., on the request submitted by Alf Properties, LLC to rezone 32.2 acres from “A” Agricultural District to “C-M” Commercial and Manufacturing District in order to construct a tree farm and nursery, landscape business, and retail garden center located at the southwest corner of Highway 218 and West Cedar Wapsi Road (County Highway C-57), and

WHEREAS, “An Ordinance Amending Ordinance No. 36, as Amended, the Black Hawk County, Iowa, Agricultural Preservation Zoning Ordinance Adopted February 2, 1999, by adding Subsection No. 182 to Section VI (B), Rezoning Certain Property” as described on the above request submitted by Alf Properties, LLC and to consider same for adoption and if adopted would be known as Ordinance no. 77-182, and

WHEREAS, §331.302(5) of the Code of Iowa allows the Board of Supervisors to suspend by majority vote the requirement to consider and vote on a proposed ordinance at two meetings of the board prior to the meeting at which it is to be fully passed, and

WHEREAS, there were no corrections to the ordinance,

NOW THEREFORE BE IT HEREBY RESOLVED that the rules requiring the Board of Supervisors to consider and vote on a proposed ordinance at two prior meetings be suspended.

                AYES:  Laylin , Little, Schwartz, White, Magsamen.

                NAYS:  None.                                                     Resolution adopted.

                White moved the following ordinance seconded by Little.

WHEREAS, “An Ordinance Amending Ordinance No. 36, as Amended, the Black Hawk County, Iowa, Agricultural Preservation Zoning Ordinance Adopted February 2, 1999, by adding Subsection No. 182 To Section VI (B), Rezoning Certain Property” as described on the above request submitted by Alf Properties, LLC and to consider same for adoption and if adopted would be known as Ordinance No. 77-182, and

WHEREAS, pursuant to §331.302(5) of the Code of Iowa, the Board of Supervisors has suspended by majority vote the requirement to consider and vote on a proposed ordinance at two meetings of the board prior to the meeting at which it is to be finally passed, and

NOW THEREFORE BE IT HEREBY RESOLVED that the same is hereby zoned acres from “A” Agricultural District to “C-M” Commercial and Manufacturing District, and the ordinance is hereby adopted and known as Ordinance #77-182.

                AYES:  Laylin , Little, Schwartz, White, Magsamen.

                NAYS:  None.                                                     Ordinance adopted.

                  ANY REPORTS OR INFORMATION FROM THE BOARD.  Magsamen said he is disappointed that the Iowa Legislature is passing laws that have no regard for local control, which isn’t good for government.  Schwartz agreed.  White said some of the laws won’t be good for citizens either.  Schwartz said Trumpcare will have an effect on residents at Country View.

The Board recessed until 10:00 a.m. when it reconvened for a closed session.

                Little moved the following resolution seconded by White.

BE IT HEREBY RESOLVED that pursuant to the provisions of the Iowa Open Meetings Law, by the Authority of the Code of Iowa, Chapter 21.5(1)(i) the Black Hawk County Board of Supervisors shall proceed into closed session for the purpose:

  1. To discuss the professional competency of individuals whose appointment, hiring or performance is being considered when necessary to prevent needless and irreparable injury to that individual’s reputation and the individual requests a closed session. 

                AYES:  Laylin, Little, Schwartz, White, Magsamen.

                NAYS:  None.                                                     Resolution adopted.

                The Board met in closed session.

                The Board recessed at 10:43 a.m. and reconvened at 11:00 a.m. to discuss the professional competency of an applicant who requested a closed session.

                Moved by Schwartz, seconded by White that the Board of Supervisors meeting in closed session be adjourned.  Motion carried.

                The Board recessed at 11:40 a.m. and reconvened at 1:00 p.m. and interviewed Lorena Gingerich, who did not request a closed session, for the position of Human Resources Director.

                On motion and vote the meeting adjourned.
