COUNCIL PROCEEDINGS September 11, 2017 

The City Council of La Porte City, Iowa met in regular session on September 11, 2017 at Hawkins Library.  Mayor David Neil called the meeting to order at 7:00 PM with Council Members Jasmine Gaston, Kristi Harrill, Mike Johnson and Brent Sadler present. Absent was Council Member Eric Allsup. Also present were Jolene Kronschnabel, Mike Whittlesey and Laura Folkerts.  Unless otherwise noted, all actions passed by affirmative and unanimous vote of the council members present.  Moved by Sadler, seconded by Gaston to approve the agenda.   Moved by Sadler, seconded by Harrill to approve the CONSENT AGENDA including the following: Minutes of August 14, 2017, disbursements, totaling $63,179.38 and Clerk’s Report for August 2017.   Library Director Jolene Kroschnabel presented the ANNUAL LIBRARY REPORT FOR 2017. In 2017, patrons saved a total of $225,515 by using the library instead of purchasing materials, 23,779 items were circulated and 9,756 individuals participated in library programs.   Moved by Sadler, seconded by Harrill to APPOINT LAURA FOLKERTS AS THE CITY ATTORNEY FOR CIVIL MATTERS.  The appointment is effective immediately and will run until December 31, 2017. Folkerts is with the law firm Dutton, Braun, Staack & Hellman.  Moved by Harrill, seconded by Gaston to ADOPT RESOLUTION 17-59 ESTABLISHING RATES OF COMPENSATION FOR THE CITY ATTORNEY. The resolution sets the hourly rate for Laura Folkerts at $175/hr. Moved by Sadler, seconded by Gaston to ADOPT RESOLUTION 17-60 SETTING THE RATE OF COMPENSATION FOR THE UTILITY BOARD OF TRUSTEES.  The resolution sets the rate of compensation at $600.00 annually to be paid in quarterly payments of $150.00 each. Roll call vote passed 3-0 with Johnson abstaining due to a conflict of interest.  The resolution is effective January 1, 2018.   Moved by Sadler, seconded by Harrill to ADOPT THE FIRST READING OF ORDINANCE 523 ESTABLISHING SOLID WASTE AND RECYCLING COLLECTIONS FEES. The ordinance includes in increase to commercial collection rates. Residential rates will not change. The second reading will take place at the September 15, 2017 meeting.The Council reviewed information on a HOUSING NEEDS STUDY AND URBAN REVITALIZATION PLAN. The Urban Revitalization Plan would allow the City to offer tax abatements on new housing as well as improvements to existing. Estimated cost for the Housing Needs Assessment is $8,000 – $10,000 and $7,500 for the Urban Revitalization Plan. Both would be completed by the Iowa Northland Regional Council of Governments. The Clerk will have contracts for both prepared for the next City Council meeting.   The Council reviewed PROPOSED POOL POLICY CHANGES. The changes were proposed by the La Porte City Parks & Recreation Commission. The commission proposed changing the pool closing policy to eliminate closing due to low attendance. The Council discussed leaving the minimum number of swimmers for closing, but requiring that the facility be open for at least 2 hours before any attendance related closing takes place.   The Parks & Recreation Commission also proposed allowing patrons under the 48” height limit to use the water slide while sitting on the lap of a parent or responsible adult.
