AN ORDINANCE AMENDING CHAPTER 106, SECTION 08
OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE CITY, IOWA,
PERTAINING TO SOLID WASTE AND RECYCLING COLLECTION FEES

BE IT ENACTED by the City Council of the City of La Porte City, Iowa:

SECTION 1. SECTION REPEALED AND REPLACED. The Code of Ordinances of the City of La Porte City, Iowa, is hereby amended by deleting the existing Chapter 106, Section 08 and adopting the following new Chapter 106, Section 08 in lieu thereof:

106.08 COLLECTION FEES. The collection and disposal of solid waste and recyclable materials as provided by this chapter are declared to be beneficial to the property served or eligible to be served and there shall be levied and collected fees therefore as follows:

SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional.

SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
