Waterloo, Iowa March 27, 2018

The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Frank Magsamen, Chris Schwartz and Tom Little, Chair pro tem.
Absent: Craig White, Chair.
Unless otherwise noted, all actions were approved unanimously, White absent.
Moved by Magsamen, seconded by Laylin that the AGENDA be received and place on file with the County Auditor as approved. Motion carried.
PUBLIC COMMENTS. Daryl Dixon of rural La Porte City read a letter about the problems with keeping the gravel on Kober Road, and the importance of replacing the Cedar Valley Nature Trail bridge over Wolf Creek because of the hazards of the detour onto Canfield and Brandon Roads.

BE IT HEREBY RESOLVED by the Board of Supervisors of Black Hawk County, that the Board of Supervisor approve the expenditure of not to exceed $75,111.66 to Black Hawk County Abstract and Title Company for closing costs in the flood buyout of the property at 5407 Weiden Road.
Finance Director Susan Deaton said that a flood buyout closing has been delayed and the exact amount the county pays for closing costs won’t be known until later in the week, and on the advice of the County Attorney’s Office she has added $100 to the estimated cost and brought it as a separate expenditure item.

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said paved roads are in good condition after the weekend’s snowstorm, and while gravel roads south of Highway 20 are in fair condition, those north of Highway 20, which received more snow, are in poor condition, and have experienced drifting.

UPDATES-Ben Delagardelle d/b/a Urban Services, Inc. gave his monthly Washburn Sanitary Sewer System update. He said in both January and February there were no One-Call locates and five services calls. He said he has an inventory of four 2000 pumps and one new Extreme. He has an agenda item for the purchase of five refurbished pumps, which he has had good success with. Little asked about available funds in the Washburn Sewer Fund. Finance Director Susan Deaton said there is a balance of $145,000.

BE IT HEREBY RESOLVED that the AGREEMENT between Black Hawk County and the First Judicial District Department of Correctional Services agreeing to provide supervision and alternate inmate housing for prisoners who would otherwise be placed in the Black Hawk County Jail in the amount of $260,000 be approved.

BE IT HEREBY RESOLVED that the COOPERATIVE AGREEMENT between Black Hawk County and the City of Waterloo for improvements to County Road V43 (Elk Run Road) from Donald Street northerly to County Road C66 (Dunkerton Road) with an estimated cost of $11,355 of the City of Waterloo (Project FM-C007(149)-55-07 Elk Run Road/Donald Street Intersection resurfacing) be approved and direct the Chair to sign for same as recommended by Catherine Nicholas, County Engineer.
Nicholas said that the City of Waterloo is paying for one-fourth of this project.

Vernon, IA, for demolition services for Flood Buy-Out Property 5407 Weiden Road, Waterloo, Iowa (Parcel No. 8812-17-252-007) with a bid of $14,512.00 be approved and for the chair to sign the contract, conditional to the receipt of the certificate of insurance.
Deaton said this was the only bid received, but it is under the estimate, it meets requirements, and Superintendent of Maintenance Rory Geving checked the references.

Moved by Magsamen, seconded by Schwartz that the REQUEST FOR PURCHASE OF CAPITAL EQUIPMENT submitted by Kim Veeder, Information Technology Director, be approved and direct the Chair to sign for same: to purchase 3 tablets for $1,774.23 and the Adobe Acrobat for $251.70 from CDW-G, to be used by the Medical Examiner and his investigators.
Information Technology Director Kim Veeder said that medical investigators can enter information on the tablets during autopsies, which can then be loaded onto the Medical Examiner’s server for him to sign and email to the appropriate law enforcement authorities, which translates into savings. Motion carried.
Moved by Laylin, seconded by Schwartz that the PERSONNEL REQUISITION for the Equipment Operator I, (full time) in the Secondary Roads Department be approved, as recommended by Catherine Nicholas, County Engineer. Motion carried.
Magsamen moved the following resolution seconded by Schwartz.
BE IT HEREBY RESOLVED that the LETTER OF SUPPORT for the Cedar Trails Partnership to submit a proposal for a grant to fund the Cedar Valley Nature Trail/Wolf Creek Bridge Project be approved.

Laylin moved the following resolution seconded by Schwartz.
BE IT HEREBY RESOLVED that the OPINION ARTICLE in support of the Iowa Legislature fully funding the property tax backfill for commercial and industrial properties be approved for submission to the Waterloo-Cedar Falls Courier.
County Auditor Grant Veeder said that a number of years ago the Iowa legislature lowered taxable values for commercial and industrial properties, and had been “backfilling” the lost revenues by reimbursing local governments. Now a bill in the Iowa legislature would phase out the backfill, starting in FY19, for which local governments have already set their budgets based on the amount of reimbursement received under current law. Magsamen said that the legislature and the governor promised to fund the reimbursement, and would not be living up to their promise should this bill pass. He said the county stands to lose $350,000 in revenue in FY19, out of the current annual amount of over $974,000.

Schwartz moved the following resolution seconded by Laylin.
BE IT HEREBY RESOLVED that Black Hawk County collect a total of $1,565.19 from Phillip Wendling, 27% of $5,797.00 that Black Hawk County paid for Iowa Law Enforcement Academy training per the employment agreement between Black Hawk County and Phillip Wendling.

At Nine-twenty-three o’clock (9:23) a.m., a public hearing was held as provided by law in Board Room 201 of the Black Hawk County Courthouse, 316 E. 5th Street, Waterloo, Iowa at which time all interested persons could appear to file objections on the proposed Sheriff’s Office Parking Lot Project.
Moved by Laylin seconded by Schwartz to receive and place on file proof of publication of notice of public hearing. Motion carried.
Moved by Laylin seconded by Schwartz to close the hearing after oral/written comments are received. Motion carried.
At nine-twenty-three (9:23) a.m. the Chair announced the time had arrived in accordance with prior action and as advertised, for the receiving and opening of bids for the proposed Sheriff’s Office Parking Lot Project.
The Board of Supervisors examined proof of publication of notice to bidders and determined that said notice had been published in the Waterloo Courier on March 9, 2018 in accordance with the requirements of the Code of Iowa.
The Chair announced the following sealed bids were all received by three o’clock (3:00) p.m. Monday March 26, 2018 as stated in the Notice to Bidders. The time of announcement being nine-twenty-four (9:24) a.m., the following bids were opened and read:

Little asked Geving why he thought only one bid was submitted. Geving said that several contractors were invited to bid three weeks ago, and the bidding was timed to occur when contractors wouldn’t have much scheduled yet, and it was a high profile project, so he was surprised by the low number of bids. He conjectured that bidding may have been affected by the factor of contaminated material removal, and the large amount of fill to be removed.
